Donald Riffle took Bertha Don Carlos to Attorney Wellings office and made a will in Feb. 2007.
Her docter (Glover) said in an diagnosis she had problematic dementia for at least a year when this happened. Written into the will she claimed that she had never adopted Sheryl Don Carlos. Judge Cook’s judgment says yes Sheryl was adopted. Bertha’s mental condition was so bad that she did not know she had an adopted daughter. In a deposition Riffle admitted that he then destroyed a 2003 will.
That was the last will she made before she got dementia. We found a copy of that will and in a deposition Attorney Welling said that the 2003 will was signed and noterized. It was the valid will until Donald Riffle detroyed it while Bertha had dimentia.
There are 4 wills an Aug 2007 will (exact duplicate of 2003 will) It is the accepted will at this time. A copy of the Feb 2007 will, a copy of the 2003 will and an original 1991 will. The last three wills are on hold.
Enter attorney Rob Russell for the adopted daughter. He claimed that none of the wills are good and he and the adopted daughter should share everything. (he is on contingency).
Enter judge Liston from Sedalia. Friend of attorney Rob Russell. He claimed we agreed that the Aug 2007 was not the last will that Bertha made. (not true and was not in writing). The 2003 and the 1991 will were not litigated and defaulted while they were on hold.
Judge Liston gave a summary judgement that none of the wills are good. Our loss will be approximatly 2,000,000.00.
